Legal Problems Regarding Noise Pollution Caused by Vehicles

Abstract

This independent study aims to (1) Study the background and concepts of the provisions of laws regarding noise pollution, (2) study the environmental legal measures in Thailand, England and Canada, (3) analyze the problems caused by noise pollution, and (4) to enforce and solve environmental legal problems, whichstudied in accordance with the Environmental Quality Promotion and Conservation Act B.E. 2535. This independent study is a qualitative study using documentary research methods by searching for documents, books, academic textbooks, articles, theses, related official documents, announcements, and various media in Thailand, England, and Canada about environmental pollution problems and the opinions of experts in order to analyze and find effective solutions.The results of the study found that (1) informed of the theoretical concepts of environmental problems and applied them to solve environmental problems; (2) Gain knowledge about Thai law compared to foreign laws in England and Canada; (3) Therefore, there are noise control measures for residential areas and laws to control noise from aircraft in order to maintain the balance of the environment and eliminate toxic substances that are harmful to health.; (4By amending the law by proposing to increase the fines under Section 65 and Section 68, and setting a long-term solution by creating a specific agency to control, inspect, and supervise noise pollution and to enforce the law effectively.

การศึกษาค้นคว้าอิสระเรื่องนี้มีวัตถุประสงค์เพื่อ(1)ศึกษาความเป็นมาและแนวคิดบทบัญญัติของกฎหมายเกี่ยวกับมลพิษทางเสียง(2)ศึกษามาตรการทางกฎหมายสิ่งแวดล้อมในประเทศไทยและอังกฤษและแคนนาดา(3)วิเคราะห์ปัญหาที่เกิดจากมลพิษทางเสียง(4)หาแนวทางในการบังคับใช้และแก้ปัญหากฎหมายเกี่ยวกับสิ่งแวดล้อมซึ่งจะศึกษาตามพระราชบัญญัติส่งแสริมและรักษาคุณภาพสิ่งแวดล้อม พ.ศ 2535 การศึกษาค้นคว้าอิสระนี้เป็นการศึกษาด้วยการวิจัยเชิงคุณภาพด้วยวิธีการวิจัยทางเอกสาร ด้วยการค้นคว้าเอกสารหนังสือ ตำราวิชาการต่างๆ บทความ วิทยานิพนธ์ เอกสารราชการที่เกี่ยวข้อง ประกาศ รวมทั้งสื่อต่าง ๆ ทั้งในประเทศไทย อังกฤษและแคนนาดา เกี่ยวกับปัญหามลพิษในสิ่งแวดล้อม และความคิดเห็นของผู้ทรงคุณวุฒิ เพื่อมาวิเคราะห์หาแนวทางการแก้ปัญหาที่มีประสิทธิภาพต่อไป ผลการศึกษาพบว่า (1)ได้ทราบถึงแนวคิดทฤษฎีของปัญหาสิ่งแวดล้อมและนำมาใช้แก้ปัญหาสิ่งแวดล้อม (2) ได้รับความรู้เกี่ยวกับกฎหมายไทยเปรียบเทียบกับกฎหมายต่างประเทศอังกฤษและแคนนาดา (3) จึงมีการควบคุมระดับเสียงที่ใช้สำหรับบริเวณที่อยู่อาศัยและกฎหมายที่ใช้ควบคุมเสียงจากอากาศยาน เพื่อบำรุงรักษาความสมดุลของสภาพแวดล้อมและพึงขจัดสิ่งที่เป็นพิษที่ทำลายสุขภาพได้(4) โดยให้มีการแก้ไขกฎหมายโดยเสนอเพิ่มโทษปรับตามมาตรา 65 และในมาตรา 68ให้สูงขึ้น พร้อมทั้งกำหนดแนวทางแก้ปัญหาระยะยาว โดยให้มีหน่วยงานเฉพาะเฉพาะเพื่อควบคุม ตรวจสอบ ดูแลการก่อมลพิษทางเสียงและมีการบังคับใช้กฎหมายอย่างมีประสิทธิ์ภาพ
