Legal issues to protect one's own rights or others' rights from perils.By acting reasonably to the cause.

Abstract

This independent study aims to 1) study the concept, theory, principles and background of protecting one's or others' rights from danger. 2) study and compare legal measures related to protecting one's or others' rights from perils in Thailand and the United States, Canada, and England. 3) analyze legal measures related to protecting one's own rights or others' rights from perils in Thailand and the United States, Canada, and England. 4) Study suggest measures to improve laws for protecting one's or others' rights from perils. This independent study is a qualitative research using the document research method by collecting all relevant information including Thai laws, US laws, Canadian laws, and British laws, as well as books, articles, journals, academic documents, research, theses, and information from the Internet. In terms of analysis, the researcher has analyzed qualitative data from the information obtained from the above documents in order to make further recommendations. The results of the study found that 1) The concept, theory, and principles of protecting one's or others' rights from danger have unclear and unstable principles. For example, the legal provisions of Thailand are not comprehensive enough to be enforced. 2) The legal systems of Thailand, the United States, Canada, and England all have different laws that apply to the principles of protecting one's or others' rights from perils. 3) Thailand currently has no legal measures to protect the rights of those who defend their own or others' rights from danger. 4) The principles of protecting one's or others' rights from perils should be amended to be correct and have clear principles by amending the legal provisions to be clearer and adding new related legal provisions.

การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อ 1) ศึกษาแนวคิด ทฤษฎีหลักการและความเป็นมาของการป้องกันสิทธิของตนหรือของผู้อื่นให้พ้นภยันตราย 2) ศึกษาเปรียบเทียบมาตรการทางกฎหมายที่เกี่ยวข้องกับการป้องกันสิทธิของตนหรือของผู้อื่นให้พ้นภยันตรายในประเทศไทยกับประเทศสหรัฐอเมริกา ประเทศแคนาดา และประเทศอังกฤษ 3) วิเคราะห์มาตรการทางกฎหมายที่เกี่ยวข้องกับการป้องกันสิทธิของตนหรือของผู้อื่นให้พ้นภยันตรายโดยกระทำพอสมควรแก่เหตุของประเทศไทยกับประเทศสหรัฐอเมริกา ประเทศแคนาดา และประเทศอังกฤษ และ 4) ศึกษาข้อเสนอแนะมาตรการในการปรับปรุงข้อกฎหมายการป้องกันสิทธิของตนหรือของผู้อื่นให้พ้นภยันตรายการศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพด้วยวิธีวิจัยจากเอกสารโดยรวบรวมข้อมูลทั้งหมดที่เกี่ยวข้องได้แก่กฎหมายของประเทศไทย กฎหมายของสหรัฐอเมริกา ประเทศแคนาดา และประเทศอังกฤษ รวมถึงหนังสือ บทความ วารสาร เอกสารทางวิชาการ งานวิจัย วิทยานิพนธ์ และข้อมูลจากเครือข่ายอินเทอร์เน็ตในส่วนของการวิเคราะห์ผู้วิจัยได้วิเคราะห์ข้อมูลเชิงคุณภาพจากข้อมูลที่ได้จากเอกสารข้างต้น เพื่อจัดทำข้อเสนอแนะต่อไปผลการศึกษาพบว่า 1) แนวคิด ทฤษฎี หลักการป้องกันสิทธิของตนหรือของผู้อื่นให้พ้นภยันตรายมีหลักเกณฑ์ที่ไม่ชัดเจนและมั่นคง เช่น บัญญัติตัวบทกฎหมายของประเทศไทยไม่ครอบคลุมพอแก่การบังคับใช้ 2) ระบบกฎหมายประเทศไทย สหรัฐอเมริกา ประเทศแคนาดาและประเทศอังกฤษ ต่างมีกฎหมายที่ใช้ในเรื่องหลักการป้องกันสิทธิของตนหรือของผู้อื่นให้พ้นภยันตราย แตกต่างกัน 3) ประเทศไทยยังไม่มีมาตรการทางกฎหมายที่จะบังคับใช้เพื่อคุ้มครองสิทธิของผู้ป้องกันสิทธิของตนหรือของผู้อื่นให้พ้นภยันตรายในปัจจุบัน 4) ควรแก้ไขหลักการป้องกันสิทธิของตนหรือของผู้อื่นให้พ้นภยันตรายให้ถูกต้องและมีหลักการที่ชัดเจนโดยแก้ไขบทบัญญัติกฎหมายให้ชัดเจนยิ่งขึ้นและเพิ่มเติมบทบัญญัติกฎหมายที่เกี่ยวข้องใหม่ขึ้น
