| dc.description.abstract | การวิจัยนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาแนวคิดและทฤษฎีเกี่ยวกับการคุ้มครองแรงงานภาคเกษตรกรรม (2) ศึกษามาตรการทางกฎหมายเกี่ยวกับการคุ้มครองแรงงานเด็กในภาคเกษตรกรรมตามกฎหมายไทยและกฎหมายของต่างประเทศ ได้แก่ กฎหมายของประเทศเดนมาร์ก ราชอาณาจักรเนเธอร์แลนด์ สาธารณรัฐสังคมนิยมเวียดนามและสหพันธรัฐมาเลเซีย (3) วิเคราะห์เปรียบเทียบกฎหมายไทยและกฎหมายของต่างประเทศเกี่ยวกับการคุ้มครองแรงงานเด็กภาคเกษตรกรรมตาม ข้อ (2) และ (4) เสนอแนะแนวทางปรับปรุง แก้ไขกฎหมายคุ้มครองแรงงานเด็กภาคเกษตรกรรม พ.ศ. 2557 งานวิจัยเรื่องนี้เป็นการวิจัยเชิงคุณภาพด้วยวิธีวิจัยเอกสาร โดยศึกษาจากพระราชบัญญัติคุ้มครองแรงงาน พ.ศ. 2541 กฎกระทรวงว่าด้วยการคุ้มครองแรงงานในงานเกษตรกรรม พ.ศ. 2557 กฎระเบียบ ข้อบังคับ อนุสัญญาองค์การแรงงานระหว่างประเทศ บทความ วารสาร วิทยานิพนธ์ ของประเทศไทยและต่างประเทศ โดยการวิจัยครั้งนี้ ผู้วิจัยได้รวบรวมข้อมูลให้เป็นระบบซึ่งในส่วนของการวิเคราะห์ข้อมูลงานวิจัย ผู้วิจัยทาการสังเคราะห์และวิเคราะห์ข้อมูลเชิงคุณภาพจากเนื้อหาที่ได้จากการวิจัยเอกสารและการทบทวนวรรณกรรม เพื่อนามาเป็นแนวทางในการจัดทาข้อเสนอแนะแก้ไขเพิ่มเติมกฎหมายในเรื่องมาตรการคุ้มครองแรงงานเด็กในงานภาคเกษตรกรรม ผลการศึกษาพบว่า (1) กฎหมายคุ้มครองแรงงานเด็กในงานภาคเกษตรกรรม จะต้องให้ความคุ้มครองแรงงานเด็กในภาคเกษตรกรรมเท่าเทียมกับแรงงานเด็กในงานภาคอุตสาหกรรมและพาณิชยกรรม เพื่อแรงงานเด็ก ในภาคเกษตรกรรมมีคุณภาพชีวิตที่ดีขึ้น ตามทฤษฏีความเสมอภาค โดยได้รับความคุ้มครองตามกฎหมายอย่างเดียวกัน (2) มาตรการคุ้มครองแรงงานเด็กในภาคเกษตรกรรมของไทยได้รับการคุ้มครองตามพระราชบัญญัติคุ้มครองแรงงาน ซึ่งกฎหมายดังกล่าวมีลักษณะคุ้มครองแรงงานทั่วไป ในส่วนกฎหมายต่างประเทศ ประเทศเดนมาร์กและสหพันธรัฐมาเลเซีย มีกฎหมายคุ้มครองแรงงานสาหรับเด็กเฉพาะโดยบังคับใช้กับแรงงานเด็กทุกสาขาอาชีพ สาหรับราชอาณาจักรเนเธอร์แลนด์มีกฎหมายคุ้มครองแรงงานภาคเกษตรเฉพาะ ใช้กับแรงงานทุกประเภทรวมทั้งแรงงานเด็กด้วย นอกจากนี้สาธารณรัฐสังคมนิยมเวียดนาม มีประมวลกฎหมายแรงงานซึ่งจาแนกเป็นหมวดแรงงานเด็ก แรงงานผู้ใหญ่ไว้ชัดเจน (3) จากการศึกษาเปรียบเทียบกฎหมายของประเทศประเทศเดนมาร์ก ราชอาณาจักรเนเธอร์แลนด์ สาธารณรัฐสังคมนิยมเวียดนามและสหพันธรัฐมาเลเซีย พบว่า กฎหมายคุ้มครองแรงงานเด็กในงานเกษตรกรรมในประเทศดังกล่าว มีกฎหมายให้ความคุ้มครองแรงงานเด็กแยกจากแรงงานผู้ใหญ่ และมีกฎหมายคุ้มครองแรงงานในภาคเกษตรกรรมแยกจากงานในภาคอุตสาหกรรม โดยกฎหมายดังกล่าวมีข้อบัญญัติสาหรับใช้กับแรงงานเด็กไว้บางเรื่องโดยเฉพาะ (4) เสนอให้แก้ไข ขอบเขตการใช้บังคับ บทนิยาม งานที่อาจก่อให้เกิดอันตรายสาหรับลูกจ้างเด็ก เวลาการทางาน ค่าตอบแทน วันหยุดพักผ่อนประจาปี วันลาเพื่อศึกษาหรืออบรม และความปลอดภัยในการทางาน เพื่อให้กฎกระทรวงคุ้มครองแรงงานในงานเกษตรกรรม พ.ศ. 2557 มีมาตรการคุ้มครองลูกจ้างเด็กในงานเกษตรกรรมชัดเจน ครอบคลุมลูกจ้างเด็กที่ทางานเกษตรกรรมตลอดปีและมิได้ให้ทางานในลักษณะที่เป็นงานอุตสาหกรรมต่อเนื่องจากงานเกษตรกรรม ให้ได้รับความเสมอภาคและเท่าเทียมกั | th_TH |

| dc.description.abstractalternative | This research aims to:(1) Study the concepts and theories concerning labor protection in the agricultural sector. (2) Study the legal measures relating to child labor protection in the agricultural sector according to Thai and foreign laws, namely: Laws of Denmark, Netherlands, Vietnam and Malaysia. (3) Analyze and compare the laws of Thai and foreign laws relating to child labor protection in the agricultural sector under (2) and (4) Suggest improvement guidelines and amend the Child Labor Protection Law in Agriculture Sector B.E. 2014. This research is a qualitative research by document research method. By studying the Labor Protection Act B.E. 2541 (1998), Ministerial Regulation on Labor Protection in Agriculture B.E. 2557 (2014), rules, regulations, ILO conventions, articles, thesis of Thailand and foreign countries. By this research, the researcher has compiled the data into a system in which the analysis of research data and the researcher synthesize and analyze qualitative data based on the content of research, documentation and literature reviews to be used as a guideline for making recommendations to amend the law on measures to protect child labor in the agricultural sector. The results of the study found that (1) the Child Labor Protection Act in the agricultural sector must provide equal protection for child labor in the agricultural sector to that of child labor in the industrial and commercial sectors for child labor in the agricultural sector to have a better quality of life according to the equality theory by being protected by the same law. (2) Child labor protection measures in the Thai agricultural sector are protected under the Labor Protection Act which the said law has a general labor protection nature in foreign law Denmark and the Federation of Malaysia there are specific child labor protection laws that apply to child labor in all occupations for the Netherlands there are specific laws protecting agricultural workers this applies to all types of labor, including child labor. In addition, the Socialist Republic of Vietnam there is a labor code which is classified as child labor adult labor clearly. (3) From a comparative study of the laws of Denmark, the Netherlands, the Socialist Republic of Vietnam and the Federation of Malaysia, it was found that the laws protecting child labor in agriculture in such countries there is a law to protect child labor separately from adult labor and there is a law to protect workers in the agricultural sector separately from those in the industrial sector. The law contains specific provisions for child labor. (4) To offer to amend the scope of enforcement, definition, jobs that may pose a danger to young employees, working time, compensation annual vacation, working time, leave for study or training and safety at work. In order for the Ministerial Regulation on Labor Protection in Agriculture B.E. 2557 (2014), there are clear measures to protect child workers in agriculture.
