| dc.description.abstract | วิทยานิพนธ์เรื่องนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาถึงความคิดอันเป็นรากฐานของกฎหมายการเดินอากาศกับอากาศยานไร้คนขับ เพื่อให้ทราบความหมาย ความมุ่งหมาย ตลอดถึงลักษณะสำคัญทางกฎหมายซึ่งแตกต่างจากกฎหมายประเภทอื่น (2) ศึกษามาตรการการใช้บังคับกฎหมายการเดินอากาศกับอากาศยานไร้คนขับของประเทศไทยประเทศสิงคโปร์ และประเทศแคนาดา (3) วิเคราะห์ปัญหาการใช้บังคับกฎหมายการเดินอากาศกับอากาศยานไร้คนขับของประเทศไทยเปรียบเทียบกับประเทศสิงคโปร์ และประเทศแคนาดา (4) เสนอแนะแนวทางในการปรับปรุงและพัฒนากฎหมายการเดินอากาศกับอากาศยานไร้คนขับของประเทศไทยให้มีประสิทธิภาพในการใช้บังคับมากยิ่งขึ้นวิทยานิพนธ์นี้เป็นการวิจัยทางกฎหมายโดยการวิจัยเชิงคุณภาพ ด้วยวิธีการวิจัยเอกสารจากเอกสารต่างๆ หนังสือ วารสาร บทความ ฐานข้อมูลอิเล็กทรอนิกส์ ตำราวิชาการ อนุสัญญาที่ประเทศไทยเข้าร่วมเป็นภาคีด้านการบิน ตัวบทกฎหมาย เอกสารทางราชการ และเอกสารอื่นที่เกี่ยวข้องแล้วนำมารวบรวมวิเคราะห์และสรุปเสนอแนะแนวทางในการปรับปรุงและพัฒนากฎหมายการเดินอากาศกับอากาศยานไร้คนขับต่อไปผลการศึกษาพบว่า (1) การใช้บังคับกฎหมายการเดินอากาศกับอากาศยานไร้คนขับนั้นถูกกำกับดูแลอย่างเคร่งครัด การกำกับดูแลนั้นมีหลายชั้น (2) จากการศึกษาเปรียบเทียบกฎหมายการเดินอากาศกับอากาศยานไร้คนขับของประเทศสิงคโปร์และประเทศแคนาดา มีกฎหมายเฉพาะสำหรับอากาศยานไร้คนขับ แต่ประเทศไทยยังไม่มีกฎหมายเฉพาะสำหรับอากาศยานไร้คนขับ (3) การวิเคราะห์เปรียบเทียบกฎหมายการเดินอากาศกับอากาศยานไร้คนขับของประเทศไทยเปรียบเทียบกับประเทศสิงคโปร์ และประเทศแคนาดา พบว่ากฎหมายประเทศไทยยังไม่มีความชัดเจนเกี่ยวกับอากาศยานไร้คนขับและบทลงโทษที่ยังไม่มีความเหมาะสมกับการกระทำผิดที่อาจเกิดขึ้นซึ่งกระทบต่อความปลอดภัยชีวิต ทรัพย์สิน และความมั่นคงของประเทศแต่ประเทศสิงคโปร์ และประเทศแคนาดา มีบทลงโทษที่รุนแรงและเด็ดขาดเพื่อป้องกันเหตุและอันตรายจากผู้ใช้อากาศยานไร้คนขับ (4) ควรให้เพิ่มเติมถ้อยคำตัวบทมาตรา 24 ของ พระราชบัญญัติการเดินอากาศ พ.ศ. 2497 แก้ไขเพิ่มเติมโดย พระราชบัญญัติการเดินอากาศ (ฉบับที่ 14) พ.ศ. 2562 โดยกำหนดให้มีการผ่านการอบรมใบอนุญาตตามที่รัฐมนตรีกำหนดการอบรมใบอนุญาตอากาศยานไร้คนขับประเภทต่าง ๆ บทลงโทษเกี่ยวกับผู้ที่ไม่มีใบอนุญาตในการบินของอากาศยานไร้คนขับประเภทต่าง ๆ ละรวมถึงโทษของการกระทำผิดซ้ำ ตามกฎหมายของประเทศสิงคโปร์ ในส่วนที่เกี่ยวข้องกับ การอบรมใบอนุญาตอากาศยานไร้คนขับประเภทต่าง ๆ การประกันภัย บทลงโทษเกี่ยวกับผู้ที่ไม่มีใบอนุญาตในการบินของอากาศยานไร้คนขับประเภทต่าง ๆ และรวมถึงโทษของการกระทำผิดซ้ำ | th_TH |

| dc.description.abstractalternative | This thesis aimed to (1) study the basic ideas of aviation law with unmanned aerial vehicle in order to understand its meaning, purpose, and important legal characteristics which are different from other types of law; (2) study the measures for enforcing aviation law with unmanned aerial vehicle in Thailand ,Singapore and Canada; (3) analyze the problems in enforcing aviation law with unmanned aerial vehicle in Thailand in comparison with Singapore and Canada.(4) To suggest a way to improve and develop the aviation laws and unmanned aerial vehicle of Thailand to be more effective in their enforcement.This thesis methodology is a legal research by qualitative research conducted through the documentary research method by collecting data from various documents, books, journals, articles, electronic databases, academic textbooks, conventions that Thailand is a party to on aviation, legal texts, official documents and other related documents, and then collecting, analyzing and summarizing to suggest guidelines for improving and developing aviation laws and unmanned aerial vehicle.The findings of research reveal that (1) the enforcement of aviation laws with unmanned aerial vehicle is strictly regulated. The supervision is multi-layered. (2) From a comparative study of aviation laws and unmanned aerial vehicle in Singapore and Canada, there are specific laws for unmanned aerial vehicle, but Thailand does not have a specific law for unmanned aerial vehicle. (3) A comparative analysis of aviation laws and unmanned aerial vehicle in Thailand compared to Singapore and Canada found that Thai laws are not clear on unmanned aerial vehicle and the penalties are not appropriate for possible offenses that affect safety of life, property and national security. However, Singapore and Canada have severe and decisive penalties to prevent incidents and dangers from unmanned aerial vehicle users. (4) The wording of Section 24 of the Aviation Act B.E. 2497, amended by the Aviation Act (No. 14) B.E. 2562, should be added to stipulate that training for licensing as prescribed by the Minister, training for licensing of various types of unmanned aerial vehicle , penalties for those without a license to fly various types of unmanned aerial vehicle , including penalties for repeat offenders, according to the Singapore in the part related to Training on licenses for various types of drones, insurance, penalties for those who do not have licenses to fly various types of drones, including penalties for repeat offenders. | en_US |
