The problem of law enforcement measures of the Department of Special Investigation in criminal offenses under the Foreign Business Act

Abstract

The purpose of this independent study is to (1) study the concept of problems of Thai laws about problems of the Department of Special Investigation in criminal cases under the Law on Business of Foreigners, (2) Study foreign laws about United States of America, Japan and Republic of Singapore and Thai laws related to such measures, (3) Study problems of Thai laws about problems of the Department of Special Investigation in criminal cases under the Law on Business of Foreigners, (4) Propose solutions to problems of Thai laws about problems of the Department of Special Investigation in criminal cases under the Law on Business of Foreigners. This independent study on this title is a document research using qualitative research methods, which will study and analyze data from relevant legal texts. Textbooks, research reports, theses, dissertations, information data, as well as related documents. Determine guidelines for resolving the problem of law enforcement measures of the Department of Special Investigation in criminal cases in accordance with the Law on Business Practices of Foreigners. The results of the study showed that (1) related concepts and theories, including economic theory, hypothetical theory, Theory of punishment for deterrence, theory of hedonism. (2) Laws of the United States and Singapore There is no definition of the term alien and the investment of foreigners is limited to businesses that have an impact on security. In Japan, foreigners who hold a total of 50% are considered foreign investors, but the United States uses a penalty system that takes into account the economic status of the offender. (3) Alien status is calculated based on shareholding in Thailand and has unclear criteria for business operations and fixed fines. (4) It is appropriate to amend the provisions of the Law on Business of Aliens in Thailand to consider the alienity by taking into account the voting rights of shareholders, and to require the investigating officer to have the same powers as officials under other laws.

การศึกษาค้นคว้าอิสระฉบับนี้ มีวัตถุประสงค์เพื่อ (1) ศึกษาถึงแนวคิด ทฤษฎีที่เกี่ยวข้องกับมาตรการบังคับใช้กฎหมายของกรมสอบสวนคดีพิเศษในคดีความผิดทางอาญาตามกฎหมายว่าด้วยการประกอบธุรกิจของคนต่างด้าว (2) ศึกษาเปรียบเทียบกฎหมายต่างประเทศของสหรัฐอเมริกา ประเทศญี่ปุ่นและประเทศสิงคโปร์ และกฎหมายไทยที่เกี่ยวข้องกับมาตรการดังกล่าว (3) ศึกษาวิเคราะห์ปัญหากฎหมายไทยที่เกี่ยวข้องกับมาตรการบังคับใช้กฎหมายของกรมสอบสวนคดีพิเศษในคดีความผิดทางอาญาตามกฎหมายว่าด้วยการประกอบธุรกิจของคนต่างด้าว (4) เสนอแนวทางในการแก้ไขปัญหามาตรการบังคับใช้กฎหมายของกรมสอบสวนคดีพิเศษในคดีความผิดทางอาญาตามกฎหมายว่าด้วยการประกอบธุรกิจของคนต่างด้าว การศึกษาค้นคว้าอิสระเรื่องนี้ เป็นการวิจัยเอกสารโดยใช้วิธีวิจัยเชิงคุณภาพ ซึ่งจะศึกษาและวิเคราะห์ข้อมูลจากตัวบทกฎหมายที่เกี่ยวข้อง ตำรา รายงานการวิจัย วิทยานิพนธ์ สารนิพนธ์ ข้อมูลสารสนเทศ ตลอดจนเอกสารต่างๆ ที่เกี่ยวข้อง โดยนำข้อมูลที่ได้จากการศึกษาเอกสารมาวิเคราะห์เปรียบเทียบ กำหนดแนวทางในการแก้ไขปัญหามาตรการบังคับใช้กฎหมายของกรมสอบสวนคดีพิเศษในคดีความผิดทางอาญาตามกฎหมายว่าด้วยการประกอบธุรกิจของคนต่างด้าว ผลการศึกษาพบว่า (1) แนวคิดและทฤษฎีที่เกี่ยวข้อง เช่น ทฤษฎีสมมติ ทฤษฎีองคาพยพ ทฤษฎีการลงโทษเพื่อการข่มขู่ยับยั้ง ทฤษฎีฮีโดนิซึม ทฤษฎีแก้แค้นทดแทน (2) กฎหมายของสหรัฐอเมริกาและประเทศสิงคโปร์ ไม่มีคำนิยามของคำว่า คนต่างด้าว และจำกัดการลงทุนของคนต่างด้าวไว้เฉพาะธุรกิจที่มีผลกระทบต่อความมั่นคงเท่านั้น ส่วนประเทศญี่ปุ่นได้กำหนดให้คนต่างด้าวถือหุ้นออกเสียงได้รวมแล้วตั้งแต่ร้อยละ 50 จะถือว่าเป็นนักลงทุนต่างด้าว สหรัฐอเมริกาใช้ระบบโทษปรับโดยคำนึงถึงฐานะทางเศรษฐกิจของผู้กระทำความผิด (3) ความเป็นคนต่างด้าวคำนวณด้วยสัดส่วนการถือหุ้นในประเทศไทย และมีหลักเกณฑ์การพิจารณาเรื่องการประกอบธุรกิจที่ไม่ชัดเจนอีกทั้งมีการกำหนดโทษปรับแบบตายตัว (4) สมควรแก้ไขบทบัญญัติของกฎหมายว่าด้วยการประกอบธุรกิจของคนต่างด้าวของไทยโดยให้พิจารณาความเป็นคนต่างด้าวโดยคำนึงถึงสิทธิในการออกเสียงของผู้ถือหุ้นด้วย และกำหนดให้พนักงานสอบสวนมีอำนาจเทียบเท่าเจ้าพนักงานตามกฎหมายอื่นด้วย และควรเพิ่มเติมโทษจำคุกและแก้ไขโทษปรับโดยคำนึงถึงความร้ายแรงของการกระทำความผิดและฐานะทางเศรษฐกิจของผู้กระทำความผิดด้วย
