Legal Problems of Controlling Offenses for Using Vehicles Carrying a Weight Exceeding Legal Limit as Provided by Laws on Highways

Abstract

This independent study aims to: (1) study concepts and theories concerning laws on controlling offenses for using vehicles carrying a weight exceeding a legal limit; (2) study legal measures in controlling offenses for using vehicles carrying weight exceeding the legal limit as provided by laws on highways in Thailand, the United States of America, and France; (3) analyze legal problems of controlling offenses for using vehicles carrying a weight exceeding the legal limit as provided by laws; and (4) render recommendations to modify laws as appropriate to solve legal problems of controlling offenses for using vehicles carrying a weight exceeding the legal limit as provided by laws. This independent study is qualitative and documentative research, in which textbooks, articles, academic papers, and internet data, both in Thai and foreign languages, were studied to analyze legal problems of controlling offenses for using vehicles carrying a weight exceeding the legal limit as provided by laws on highways, and give recommendations to modify laws on controlling offenses for using vehicles carrying a weight exceeding the legal limit as provided by laws on highways so they are efficient and appropriate. Study findings are as follows. (1) The concept of using highways is for the government to control vehicle use with the fares provided by laws, and theories used in providing laws with criminal punishments are criminal liability theory and criminal punishment theory. (2) Legal measures of Thailand are provided in the Highway Act B.E. 2535 (1992) and Highway Act (No. 2) B.E. 2549 (2006). In the US, the Ground Transportation Problem-Solving State legislation appears in Florida State’s affairs administration laws and in California State’s laws on vehicles. In France, the European Council Resolution A.D.1996 and Additional Resolution of European Parliament and European Council A.D.2015 are in place. (3) Laws of United States of America and France provide fine punishment vehicles for carrying a weight in excess of the limit. Fines increase as the excessive weight increases, which is different from Thailand. In addition, in Thailand, employers, transport companies and goods owners are not liable for such action according to the law. (4) Section 73/2 of the Highway Act (No. 2), B.E. 2549 (2006) needs amending. Appropriate fines and liabilities of employers, transport companies and goods owners should be added to the Section. Awards should be given to for arresting officers and inquiry officers at appropriate rates for further efficiency of laws.

การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์ เพื่อ (1) ศึกษาแนวคิดและทฤษฎีเกี่ยวกับ กฎหมายในการควบคุมการกระทำความผิดเกี่ยวกับการใช้ยานพาหนะบรรทุกน้ำหนักเกินกว่าที่กฎหมายกำหนด (2) ศึกษามาตรการทางกฎหมายในการควบคุมการกระทำความผิดเกี่ยวกับการใช้ยานพาหนะบรรทุกน้ำหนักเกินกว่าที่กฎหมายกำหนดในกฎหมายของประเทศไทย ประเทศสหรัฐอเมริกาและสาธารณรัฐฝรั่งเศส (3) วิเคราะห์ปัญหาทางกฎหมายในการควบคุมการกระทำความผิดเกี่ยวกับการใช้ยานพาหนะบรรทุกน้ำหนักเกินกว่าที่กฎหมายกำหนด (4) เสนอแนะแนวทางแก้ไขปรับปรุงกฎหมายที่เหมาะสมในการแก้ไขปัญหาทางกฎหมายในการควบคุมการกระทำความผิดเกี่ยวกับการใช้ยานพาหนะบรรทุกน้ำหนักเกินกว่าที่กฎหมายกำหนด การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพ โดยการวิจัยเอกสาร จากการศึกษาค้นคว้าจากหนังสือ บทความ เอกสารทางวิชาการ ข้อมูลทางอินเตอร์เน็ต ทั้งภาษาไทยและภาษาต่างประเทศ เพื่อนำมาวิเคราะห์ปัญหาทางกฎหมายในการควบคุมการกระทำความผิดเกี่ยวกับการใช้ยานพาหนะบรรทุกน้ำหนักเกินกว่าที่กฎหมายกำหนดตามกฎหมายว่าด้วยทางหลวง และเสนอแนะแนวทางในการแก้ไขปรับปรุงกฎหมายที่เกี่ยวกับการควบคุมการกระทำความผิดการใช้ยานพาหนะบรรทุกน้ำหนักเกินกว่าที่กฎหมายกำหนดตามกฎหมายว่าด้วยทางหลวง ให้มีประสิทธิภาพและเหมาะสม ต่อไป ผลการศึกษาพบว่า (1) แนวคิดในการใช้ถนนหลวงเกิดจากการที่รัฐมุ่งประสงค์การควบคุมการใช้ยานพาหนะให้เป็นไปตามอัตราที่กฎหมายกำหนดและปรากฏทฤษฎีที่รัฐนำมาใช้บัญญัติกฎหมายที่มีโทษทางอาญาในประเด็นดังกล่าว คือ ทฤษฎีความรับผิดทางอาญา และทฤษฎีการลงโทษทางอาญา (2) มาตราการทางกฎหมายของประเทศไทยปรากฏในพระราชบัญญัติทางหลวง พ.ศ. 2535 (ฉบับที่ 2) พ.ศ.2549 ส่วนมาตรการทางกฎหมายของประเทศสหรัฐอเมริกา ในส่วนของกฎหมายรัฐบาลกลาง ปรากฏในกฎหมายรัฐบัญญัติการแก้ไขปัญหาการขนส่งภาคพื้นดิน และในมลรัฐฟลอลิดาปรากฏในกฎหมายการบริหารกิจการแห่งรัฐมลฟลอริดา และมลรัฐคลิฟอร์เนีย ปรากฏในกฎหมายเกี่ยวกับยานพาหนะของมลรัฐแคลิฟอร์เนีย และสาธารณรัฐฝรั่งเศสปรากฏในกฎหมาย ซึ่งเป็นมติคณะมนตรียุโรป ค.ศ.1996 และมติเพิ่มเติมรัฐสภายุโรปและคณะมนตรียุโรป ค.ศ.2015 (3) กฎหมายของประเทศสหรัฐอเมริกาและสาธารณรัฐฝรั่งเศส มีการกำหนดอัตราโทษฐานปรับบรรทุกน้ำหนักเกินกว่าอัตราที่กฎหมายกำหนดสูงขึ้นตามลำดับน้ำหนักที่บรรทุกเกินอัตราที่กฎหมายกำหนดและยังกำหนดอัตราเพดานค่าปรับอย่างสูงไว้ แตกต่างจากประเทศไทย ที่ไม่ได้ตรากฎหมายให้เป็นไปตามน้ำหนักที่บรรทุกได้และไม่มีการบัญญัติให้นายจ้างหรือผู้ประกอบการขนส่งและหรือเจ้าของสินค้าต้องรับผิดในการกระทำดังกล่าว (4) ควรมีการแก้ไขเพิ่มเติมพระราชบัญญัติทางหลวง (ฉบับที่ 2) พ.ศ. 2549 มาตรา 73/2 โดยให้มีอัตราโทษปรับที่เหมาะสมและให้นายจ้างหรือผู้ประกอบการขนส่งและหรือเจ้าของสินค้าเข้ามาร่วมรับผิดกับผู้ขับรถบรรทุก รวมถึงมีการกำหนดเงินรางวัลค่าปรับให้แก่พนักงานผู้จับกุมและพนักงานสอบสวนเจ้าของคดีในอัตราที่เหมาะสม เพื่อเพิ่มประสิทธิภาพของกฎหมายต่อไป
