dc.description.abstractการศึกษาค้นคว้าอิสระเรื่องปัญหาการบังคับใช้พระราชบัญญัติการขุดดินและถมดิน พ.ศ. 2543 ของนายกองค์การบริหารส่วนตำบล มีวัตถุประสงค์เพื่อศึกษาแนวคิด ทฤษฎี และหลักการ (1) เกี่ยวกับเส้นทางการวิ่งบรรทุกดิน การจํากัดความเร็วของรถบรรทุกและการป้องกันดินร่วงหล่นจากรถบรรทุกลงพื้นถนนหรือรถอื่น ๆ ที่ใช้ทางร่วมกัน (2) เพื่อศึกษาหลักกฎหมายเกี่ยวข้องกับรถบรรทุกดินตลอดจนปัญหาและอุปสรรคในการดำเนินการ (3) เพื่อเสนอแนะแนวทางการแก้ไขปัญหาที่เกี่ยวกับการดำเนินการ การศึกษาค้นคว้าอิสระนี้เป็นการศึกษาเชิงคุณภาพ ด้วยวิธีการวิจัยเอกสาร ค้นคว้าจากตัวบทกฎหมายตำราบทความ เอกสาร รวมทั้งพระราชบัญญัติ และกฎระเบียบต่าง ๆ ที่เกี่ยวข้อง จากการศึกษา พบว่าในการให้อำนาจแก่นายกองค์การบริหารส่วนตำบลนั้นยังคงมีจํากัดเกี่ยวกับอำนาจหน้าที่ หรือวิธีการปฏิบัติงาน ทำให้ไม่สามารถปฏิบัติงาน หรือแก้ไขปัญหาความเดือดร้อนของประชาชนที่ได้รับความเดือดร้อนจากการบรรทุกขนส่งดินได้ ซึ่งปัญหาที่เกิดบนบกิดจากความไม่สัมพันธ์กันของกฎหมายที่กระจายอำนาจให้แก่นายกองค์การบริหารส่วนตําบลกับกฏหมายที่เกี่ยวข้องกับการชุดดินจึงควรมีการเพิ่มเติม การให้อำนาจและเพิ่มกลไกการแก้ไขปัญหาที่กระทบกับสิทธิ์ และความเป็นอยู่ของประชาชนในท้องถิ่น หากกฎหมายมิได้ให้อำนาจ หรือกฎหมายมิได้กําหนดอำนาจของนายกองค์การบริหารส่วนตําบลไว้อย่างชัดเจน การมีการบัญญัติเพิ่มเติมในส่วนของมาตรการบังคับทางปกครองให้เข้มงวดและครอบคลุมทั้งในด้านการบรรทุกขนส่งดิน การขัดขวางการเข้าตรวจสอบการขุดดิน เพื่อให้ผู้กระทําความผิดเกิดความเกรงกลัวต่อการกระทําความเดือดร้อนให้แก่ประชาชนth_TH

dc.description.abstractalternativeThis independent study on "Problems on Enforcement of the Soil Moving and Land Filling Act, B.E. 2543 by Sub-district Administrative Organizations" was intended to (1) study legal principles related to soil moving and transportation of soil; (2) analyze laws and regulations and problems related to vehicles transporting soil and authority of sub-district administrative organizations; and (3) give recommendations for solving problems related to soil moving and transportation of soil. This was a qualitative research based on documentary research of related laws and regulations, textbooks, articles and other documents. The results showed that there are certain problems on the power and authority given to chairmen of sub-district administrative organizations to enforce soil moving and land filling laws, as well as limitations on the methods they can use in practice. As a result, the chairmen are not able to fulfill their responsibilities or effectively solve problems when citizens' wellbeing is affected by soil transportation. The problems are the inconsistency between decentralization of power to local administrators and laws that are involved with soil moving and land filling. The recommendation is that the local authorities should provide more legal mechanisms that would enable them to solve problems that affect the rights and wellbeing of the citizens in their area. They should lay down the related local ordinances to include measures for stricter administrative enforcement, covering the transport of dirt and sand as well as inspections of soil moving operations so that people will be deterred from doing things that affect the wellbeing of others.en_US
