| dc.description.abstract | การศึกษาค้นคว้าอิสระเรื่อง “มาตรการทางกฎหมายในการจัดสวัสดิการผู้สูงอายุขององค์การบริหารส่วนตำบล” มีวัตถุประสงค์เพื่อศึกษาวิเคราะห์แนวคิด และหลักกฎหมายตลอดจนปัญหา อุปสรรค ข้อจำกัดทางกฎหมายที่เกี่ยวข้องในการจัดสวัสดิการผู้สูงอายุขององค์การบริหารส่วนตำบล โดยทําการเปรียบเทียบการจัดสวัสดิการผู้สูงอายุของประเทศไทยกับต่างประเทศ เพื่อ เสนอแนวทางการปรับปรุงกฎหมายตลอดจนกฎระเบียบที่เกี่ยวข้องกับการจัดสวัสดิการผู้สูงอายุขององค์การบริหารส่วนตำบลให้มีความชัดเจนและมีประสิทธิภาพมากยิ่งขึ้น การศึกษาค้นคว้าอิสระนี้ เป็นการวิจัยเชิงคุณภาพ ด้วยวิธีการวิจัยทางเอกสาร โดยการศึกษาค้นคว้าจาก ตัวบทกฎหมาย ตำรากฎหมายที่เกี่ยวข้องกับแนวคิดทฤษฎี บทความทางวิชาการบทวิเคราะห์งานวิจัยต่าง ๆ และข้อมูลจากสื่ออิเล็กทรอนิกส์ที่เกี่ยวข้อง ผลจากการศึกษาพบว่า ปัจจุบันยังไม่มีกฎหมายในการจัดสวัสดิการผู้สูงอายุบัญญัติไว้โดยเฉพาะ มีแต่กระจายอยู่ในกฎหมายฉบับต่าง ๆ เช่น รัฐธรรมนูญแห่งราชอาณาจักรไทยพระราชบัญญัติผู้สูงอายุ กฎหมายอาญา กฎหมายแพ่งและพาณิชย์ กฎหมายว่าด้วยการประกันสังคม กฎหมายว่าด้วยบำเหน็จบำนาญข้าราชการ กฎหมายว่าด้วยการศึกษาแห่งชาติ กฎหมายว่าด้วยการส่งเสริมการจัดสวัสดิการสังคม ผู้ศึกษาจึงขอเสนอแนะแนวทางการแก้ไขปัญหาดังกล่าว เช่นให้รัฐบาลกำหนดให้การจัดสวัสดิการผู้สูงอายุเป็นนโยบายแห่งชาติ และแก้ไข พระราชบัญญัติเกี่ยวกับการจัดสวัสดิการผู้สูงอายุ โดยมอบหมายหน้าที่ให้องค์การบริหารส่วนตำบลเป็นผู้รับผิดชอบหรือดำเนินโครงการ พร้อมทั้งจัดสรรงบประมาณให้องค์การบริหารส่วนตำบลทุกแห่งได้นำไปใช้ในการจัดสวัสดิการผู้สูงอายุโดยให้ครอบคลุมทุกเรื่องที่เกี่ยวข้องกับการจัดสวัสดิการผู้สูงอายุ เพื่อให้ผู้สูงอายุสามารถดำรงชีพได้อย่างมีศักดิ์ศรี และมีความสุข | th_TH |

| dc.description.abstractalternative | The independent study of The Legal Measure for The Elderly’s Welfare of The Sub-district Administrative Organization (SAO) is aimed to analyze concepts, theory, regulations, and the impediment related to theelderly’swelfare offering in the sub-district administrative organization. In order to provide the ways of regulation improvement about the elderly’s welfare of the Sub-district Administrative Organization, The study compares the welfare available for elderly in Thailand and foreign countries. This independent study is the qualitative research using the documentary method, for instant, laws books, regulations, articles, research analyses, and electronic resources related to the theory and the topic. The result of the study indicates that there is no elderly’s welfare legislation, but they are enacted in other regulation, for example, Constitution of The Kingdom of Thailand, B.E.2550, The Act on the Elderly, B.E.2546, The Criminal Law on Social Security, The Law on Government Officer’s Fringe Benefits, The Law on National Education, The Law on the Social Welfare Promotion. There are also related sub-enactment in the Royal Decree, rules and regulations of the ministries, department, and other units. Therefore, the suggestive resolutions are the government should set the elderly’s welfare into the national policy, enact the Act of Elderly’s welfare and assign the Sub-district Administrative Organization be responsible for it, and allocate the budget to every Sub-district Administrative Organizations to offer the welfare for elderly cover every kind of welfare to help elderly living in society respectably and happily | en_US |
