| dc.description.abstract | การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อ (1) เพื่อศึกษาแนวคิด ความเป็นมาเกี่ยวกับการประกอบกิจการพาณิชย์ขององค์กรปกครองส่วนท้องถิ่น และความร่วมมือกับเอกชนในการประกอบกิจการพาณิชย์ (2) เพื่อศึกษากฎหมาย และคำสั่งต่างๆ เกี่ยวกับอำนาจหน้าที่ของกรุงเทพมหานคร และความร่วมมือกับเอกชนที่ก่อให้เกิดปัญหาและอุปสรรค (3) เพื่อวิเคราะห์ปัญหาและอุปสรรคที่เกิดจากความร่วมมือระหว่างสํานักงานตลาดกรุงเทพมหานครกับเอกชน (4) เพื่อเสนอแนวทางในการปรับปรุงกฎหมายในส่วนที่เกี่ยวกับสำนักงานตลาด กรุงเทพมหานคร ให้เหมาะสม สามารถดำเนินกิจการ การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพด้วยวิธีวิจัยเอกสารจากตัวบทกฎหมาย ตำราทางวิชาการ บทความ วิทยานิพนธ์ สารนิพนธ์ รายงานการประชุมคณะกรรมการบริหารสํานักงานตลาดและศึกษาค้นคว้าวิจัยข้อมูลที่เกี่ยวข้องจากเว็บไซต์ต่าง ๆ เพื่อรวบรวมข้อมูลทั้งหลายมาทำการศึกษาวิเคราะห์ปัญหาความร่วมมือระหว่างสำนักงานตลาดกรุงเทพมหานครกับเอกชนผลการศึกษาพบว่า (1) การประกอบกิจการพาณิชย์ขององค์กรปกครองส่วนท้องถิ่น เกิดจากแนวคิดการกระจายอำนาจ ให้มีหน้าที่และอำนาจในการจัดระบบการบริการสาธารณะ เพื่อประโยชน์ของประชาชนในเขตท้องทีของตน และเป็นรายได้ขององค์กรปกครองส่วนท้องถิ่น ไม่ว่าจะดำเนินกิจการด้วยตนเองหรือร่วมกับบุคคลอื่น (2) กรุงเทพมหานคร มีอำนาจหน้าที่ดำเนินกิจการพาณิชย์ และสามารถดำเนินกิจการร่วมกับบุคคลอื่นโดยก่อตั้งบริษัทหรือถือหุ้นในบริษัทของกรุงเทพมหานคร ได้ก็ต่อเมื่อบริษัทนั้นมีวัตถุประสงค์เฉพาะกิจการเป็นสาธารณูปโภค (3) ปัญหาเนื่องจากการก่อตั้งบริษัทหรือถือหุ้นในบริษัทของกรุงเทพมหานคร ตามพระราชบัญญัติระเบียบบริหารราชการกรุงเทพมหานคร พ.ศ. 2528มาตรา 94 วรรคหนึ่ง (1) กำหนดให้บริษัทนั้นต้องมีวัตถุประสงค์เพื่อกิจการเป็นสาธารณูปโภคเท่านั้นแต่การดำเนินกิจการของสำนักงานตลาดกรุงเทพมหานคร มิได้มีวัตถุประสงค์ดำเนินกิจการเพื่อสาธารณูปโภคจึงเป็นเหตุให้ไม่อาจร่วมกับบุคคลอื่นโดยก่อตั้งบริษัทหรือถือหุ้นในบริษัทได้ (4) ผู้ศึกษาจึงขอเสนอแนะให้มีการแก้ไขในหลักการ โดยขยายวัตถุประสงค์การทำกิจการร่วมกับบุคคลอื่นโดยก่อตั้งบริษัทหรือถือหุ้นในบริษัทให้รวมถึงกิจการเพื่อสาธารณะประโยชน์เชิงอุตสาหกรรมและพาณิชยกรรมด้วย เพื่อให้สํานักงานตลาดกรุงเทพมหานคร สามารถมีฐานะเป็นนิติบุคคล จัดตั้งเป็นบริษัทได้ | th_TH |

| dc.description.abstractalternative | The objectives of this independent study are (1) to study concepts and background to the commercial operations of the local government organization and cooperation with the private sector in conducting commercial businesses, (2) to study law and various orders related to authority of Bangkok Metropolitan Administration in cooperation with the private sector that may cause problems, (3) to analyze problems and obstacles arising from cooperation between the Bangkok Metropolitan Market Office and the private sector, and (4) to propose guidelines to improve the law in respect of the Bangkok Market Office to be able to operate the business with flexibility. This independent study is a qualitative research with a documented research method from the provisions of law, academic textbooks, articles, theses, dissertations, minutes of the Executive Committee meetings of Market Office, and to study and research the related information from various websites to collect all information to study and analyze problems of cooperation between the Bangkok Market Office and the private sector. The results indicated that: (1) Business operations of the local government started with concept of decentralization for having powers and duties on organize public service. This is for the benefit of people in their own locality and income of the local government organization whether it be their own operating a business or with other people. (2) Bangkok Metropolitan Administration has the power and duty to conduct commercial affairs and able to operate jointly with other persons by forming a company or holding shares in a Bangkok company only when that company has a special purpose as public utilities. (3) According to Section 94, paragraph one (1) of the Bangkok Metropolitan Administration Act, BE 2528 which stipulates that the company must have a public utility objective only. On the other hand, the operation of the Bangkok Market Office is not intended to operate for public utilities. Therefore, it may not be able to work with other persons by establishing a company or holding shares in the company. (4) Researcher suggested that it should be amended in principle by expanding the objective of operating a business with other persons by establishing companies or holding shares in a company, including in public benefit on industrial and commercial purposes so that the Bangkok Market Office can have a legal status that can be established as a company. | en_US |
