| dc.description.abstract | การศึกษาค้นคว้าอิสระ เรื่อง ปัญหาในการบังคับใช้พระราชบัญญัติควบคุมการเรี่ยไร พุทธศักราช 2487 มีวัตถุประสงค์เพื่อศึกษา (1) ความหมาย แนวคิดเกี่ยวกับการควบคุมการเรี่ยไร และการระดมทุนจากมวลชน (2) มาตรการทางกฎหมายที่เกี่ยวข้องกับการควบคุมการเรี่ยไรที่ใช้บังคับในประเทศไทย (3) วิเคราะห์ปัญหาอุปสรรคในการบังคับใช้กฎหมายว่าด้วยควบคุมการเรี่ยไร (4) เสนอแนะแนวทางแก้ไขปัญหากฎหมายว่าด้วยการควบคุมการเรี่ยไรและเพิ่มมาตรการอื่น ๆ เพื่อควบคุมการเรี่ยไร การศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพด้วยวิธีวิจัยเอกสาร โดยการค้นคว้าจากตัวบทกฎหมาย หนังสือหรือตำราทางกฎหมาย บทความทางกฎหมาย วิทยานิพนธ์ สารนิพนธ์ วารสาร บทความ และเอกสารอื่นที่เกี่ยวข้อง รวมถึงการค้นคว้าข้อมูลทางอินเตอร์เนต จากการศึกษา พบว่า บทนิยามของคำว่า “การเรี่ยไร” และลักษณะของการเรี่ยไร ไม่ครอบคลุมไปถึงลักษณะวิธีการเรี่ยไรที่ดำเนินการอยู่ในปัจจุบัน ซึ่งมีลักษณะกว้างขวางกว่า เช่น การเรี่ยไรโดยผ่านสื่อออนไลน์ กลไกการกำกับดูแลยังไม่เหมาะสม จึงควรมีการปรับปรุงกฎหมายให้ครอบคลุมถึงลักษณะวิธีการเรี่ยไรที่ใช้บังคับอยู่ในปัจจุบัน และวิธีการที่มีแนวโน้มว่าจะมีการพัฒนาขึ้นในอนาคต โดยในระยะสั้นอาจแก้ไขบทบัญญัติของกฎหมาย รวมถึงการกำหนดรายละเอียดของกระบวนการ ขั้นตอนต่าง ๆ ในการขออนุญาตทำการเรี่ยไร เพื่อสร้างการรับรู้ให้กับประชาชนผู้เข้ารับการเรี่ยไรให้ชัดเจนยิ่งขึ้น | th_TH |

| dc.description.abstractalternative | The objective of the independent study on Enforcement Problem of Collecting Contribution Control Act B.E. 2487 (1944) is to study on (1) meaning and concept related to control on collecting contribution and fundraising from masses, (2) legal measure related to control on collecting contribution enforced in Thailand, (3) analysis of enforcement obstacle and problem for Collecting Contribution Control Law, and (4) suggestion of corrective guideline for Collecting Contribution Control Law and addition of other measures for collecting contribution control. The method of this study is a qualitative documentary research. Its main sources are from laws, laws textbooks, legal articles, thesis, dissertation, journals, and other related documents, as well as information from the internet. According from the study the definition and nature of “collect contribution” is not cover the current practice which has browser scope, i.e. collecting from social media. and the governance mechanism has yet been improper. Therefore, laws should be adjust to cover the nature of current enforced collecting contribution method and methods with tendency of future development. In short-term, legal implements be amended and have clearer details of processes procedures of collecting, and contribution permission may be determined to build perception for people who participate in receiving collecting contribution | en_US |
