| dc.description.abstract | การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อศึกษาแนวคิดและสภาพปัญหาในกระบวนการคัดกรองเพื่อคัดแยกกลุ่มเป้าหมาย วิเคราะห์มาตรการคุ้มครองและพัฒนาคุณภาพชีวิตคนขอทาน และเสนอแนะแนวทางการปรับปรุงแก้ไขกฎหมายเกี่ยวกับเรื่องอำนาจในการจับกุม ผลการศึกษาพบว่า ในกระบวนการเริ่มต้นของกระบวนการคัดแยกกลุ่มเป้าหมายนั้นทีมสหวิชาชีพมีความสำคัญอย่างยิ่งในการเข้าไปมีบทบาทในการคัดกรองว่ามีกระบวนการในการคัดกรองตามกลุ่มเป้าหมายหรือไม่ แต่จากการศึกษาพบว่าพระราชบัญญัติควบคุมการขอทาน พ.ศ.2559 ยังไม่ครอบคลุมถึงกระบวนการคัดกรองเพื่อคัดแยกกลุ่มเป้าหมายโดยทีมสหวิชาชีพ ดังนั้น จึงมีความจำเป็นอย่างยิ่งที่จะต้องปรับปรุงแก้ไขกฎหมายโดยกำหนดให้มีคณะทำงานของทีมสหวิชาชีพไว้อย่างชัดเจนในกฎหมาย อีกทั้งอำนาจในการจับกุมผู้กระทำผิดนั้นยังไม่มีการบัญญัติให้องค์กรปกครองท้องถิ่นเข้ามามีอำนาจในการจับกุมและมีอำนาจในการเปรียบเทียบปรับจึงจำเป็นต้องแก้ไขกฎหมายให้องค์กรปกครองท้องถิ่นเข้ามามีอำนาจทั้งในการจับกุมและเปรียบเทียบ และข้อเสนอแนะประการสุดท้าย คือ ควรกำหนดระยะเวลาการอยู่ในสถานคุ้มครองและพัฒนาคุณภาพชีวิตคนขอทานให้ชัดเจน เนื่องจากหากระยะเวลาเน่นนานอาจเป็นการละเมิดสิทธิและเสรีภาพของคนขอทานได้ | th_TH |

| dc.description.abstractalternative | The purpose of this research is to study concept and problems in classifying target group, to analyze measure for protection and developing the quality of life of beggar and suggest-ing the ways for amendment on power in arresting. This research is qualitative research with method of documentary research consisting of documents relating to academic matter, textbooks, articles, various academic reports, electronic media, related legal provisions regardless of being legislation of Thailand or foreign country in order to analyze and synthesize data to bring about to results of research. The result of study found that in beginning of target group sorting process, interdis-ciplinary team is extremely important for the role in screening whether there is screening process as target group or not. However, the Beggar Control Act B.E. 2559 has not yet covered to screen-ing process to sort out the target group by interdisciplinary team. Therefore, it was extremely nec-essary to amend by clearly defining working group of interdisciplinary team in law including power in arresting offender. Moreover, there is no enactment to allow local administrative organi-zation has power in arresting and fine penalty, so it was necessary to amend by allowing local administrative organization to have power both arresting and fine penalty and finally, it should clearly fix period of time being in place of protection and developing the quality of life of beggar due to if it take a long time, it might affect to the right and freedom of beggar | en_US |
