Legal Problems of the Land Traffic Procedures in Thailand

Abstract

The purposes of this independent study are: (1) to study the background, legal concepts, and principles of traffic legal procedures in Thailand; (2) to examine traffic procedures under the laws of Thailand, the United States, Singapore, and Japan; (3) to analyze legal issues related to traffic litigation in Thailand; and (4) to suggest to amending traffic litigation laws in Thailand. This independent study employs qualitative research through documentary analysis, utilizing sources such as the Thailand Penal Code, the Land Traffic Act, B.E. 2522 (1979), annual reports, seminar meeting reports, dissertations, theses, teaching materials, articles, interviews, and other academic works in both Thai and foreign languages. The purpose is to analyze legal issues related to traffic law enforcement in Thailand and to propose recommendations for amending and improving traffic laws to enhance their effectiveness, appropriateness, and applicability. The study found that: (1) The concepts, principles, and legal theories related to traffic law enforcement in Thailand include the rule of law, the principle of “no crime no punishment without law”, administrative discretion, civil liability in traffic law, and the three-layer legal theory of law. (2) Traffic law enforcement in Thailand follows the Land Traffic Act, B.E. 2522 (1979), while in the United States, traffic laws are codified, and Singapore and Japan have enacted traffic laws are as standalone acts, similar to Thailand. (3) In all countries studied – Thailand, the United States, Singapore, and Japan – traffic law enforcement is carried out by police officer. Traffic cases in the United States are handled in traffic courts, whereas in Singapore and Japan, they are managed in district courts, similar to Thailand. (4) Amendments to Thailand’s traffic laws are necessary regarding the discretion exercised by traffic police officers, traffic case legal procedures, the expertise of the judges in specific areas of law, and the ineffective implementation of the demerit point system under the Land Traffic Act, B.E. 2522 (1979). These amendments aim to raise awareness and foster better traffic discipline, ultimately contributing to a reduction in traffic problems.

การศึกษาค้นคว้าอิสระนี้มีวัตุประสงค์ เพื่อ (1) ศึกษาถึงความเป็นมา แนวคิดทฤษฎีและหลักของการดำเนินคดีเกี่ยวกับการจราจรทางบกในประเทศไทย (2) ศึกษาถึงการดำเนินคดีเกี่ยวกับการจราจรทางบกตามกฎหมายไทย ประเทศสหรัฐอเมริกา สาธารณรัฐสิงคโปร์ และประเทศญี่ปุ่น (3) วิเคราะห์ปัญหาทางกฎหมายเกี่ยวกับการดำเนินคดีเกี่ยวกับการจราจรทางบกในประเทศไทย (4) เสนอแนะแนวทางในการแก้ไขเพิ่มเติมกฎหมายเกี่ยวกับการดำเนินคดีเกี่ยวกับการจราจรทางบกในประเทศไทยการศึกษาค้นคว้าอิสระนี้เป็นการวิจัยเชิงคุณภาพด้วยวิธีวิจัยเอกสารจากประมวลกฎหมายอาญา พระราชบัญญัติจราจรทางบก พ.ศ. 2522 หนังสือรายงานประจำปี รายงานการประชุมสัมมนาหรือเอกสารประกอบการประชุมสัมมนา ดุษฎีนิพนธ์และวิทยานิพนธ์ เอกสารการสอน บทความ บทสัมภาษณ์และ งานวิชาการอื่นๆ ทั้งภาษาไทยและภาษาต่างประเทศ เพื่อนำมาวิเคราะห์ปัญหาทางกฎหมายในการดำเนินคดีเกี่ยวกับการจราจรทางบกของประเทศไทย และเสนอแนะแนวทางในการแก้ไขปรับปรุงกฎหมายเกี่ยวกับการดำเนินคดีเกี่ยวกับการจราจรทางบก ให้มีประสิทธิภาพ เหมาะสม และเป็นรูปธรรม ต่อไปผลการศึกษา พบว่า (1) แนวคิด หลักการ และทฤษฎีทางกฎหมายเกี่ยวกับการดำเนินคดี เกี่ยวกับการจราจรทางบกในประเทศไทย คือ หลักนิติรัฐและหลักนิติธรรม หลักไม่มีความผิดไม่มีโทษโดยไม่มีกฎหมาย หลักการใช้ดุลพินิจของฝ่ายปกครอง หลักความรับผิดของกฎหมายจราจรในทางแพ่ง และทฤษฎีกฎหมายสามชั้น (2) การบังคับใช้กฎหมายจราจรของประเทศไทย เป็นไปตามพระราชบัญญญัติจราจรทางบก พ.ศ. 2522 ส่วนกฎหมายของประเทศสหรัฐอเมริกามีการบัญญัติเป็นประมวลกฎหมายจราจร สาธารณรัฐสิงคโปร์และประเทศญี่ปุ่น ซึ่งมีการตราเป็นพระราชบัญญัติการจราจรทางบกเช่นเดียวกับประเทศไทย (3) กฎหมายจราจรทางบกของประเทศสหรัฐอเมริกา สาธารณรัฐสิงคโปร์และประเทศญี่ปุ่น มีการบังคับใช้กฎหมายผ่าน เจ้าพนักงานตำรวจเช่นเดียวกับประเทศไทย นอกจากนี้ประเทศสหรัฐอเมริกามีการพิจารณาคดีจราจร ในศาลจราจร ส่วนสาธารณรัฐสิงคโปร์และประเทศญี่ปุ่นมีการพิจารณาคดีจราจรในศาลแขวงเช่นเดียวกับประเทศไทย (4) ควรมีการแก้ไขกฎหมายเกี่ยวกับการจราจรทางบกในประเทศไทยเกี่ยวกับการใช้ดุลพินิจของ เจ้าพนักงานตำรวจ วิธีการพิจารณาคดีจราจร ความเชี่ยวชาญกฎหมายเฉพาะของผู้พิพากษา และการบังคับใช้เรื่องการตัดคะแนนความประพฤติในการขับรถที่ไม่มีประสิทธิภาพ ตามพระราชบัญญัติจราจรทางบก พ.ศ. 2522 เพื่อให้เกิดการตระหนักถึงจิตสำนึกที่ดี อันเป็นผลให้เป็นการแก้ไขปัญหาจราจรได้อย่างเป็นรูปธรรม
