Sex Workers and the Social Rights of Citizenship in Thai Society

Abstract

This study aims to 1) study the loss of social rights of citizenship when sex workers are not legally recognized in Thai society. 2) study the impact that sex workers receive when the law does not recognize their career in Thai society. 3) suggest guidelines for having a law to recognize the career of sex workers in order to create social rights in Thai society that are appropriate and consistent with the current problems.This study is qualitative research by studying documentary research, studying and collecting data from academic documents, journals, related research, online interviews, various sources of information from the internet and interviews by purposive sampling. Then, the data is analyzed descriptively.The study found that 1) The loss of social rights of citizenship due to the fact that sex workers are not legally recognized in Thai society causes such groups of people to lose their rights from being citizens of Thai society in many aspects, such as labor welfare, violence. This is because there is no law to protect sex workers As a result, sex workers are the bottom in the food chain of Thai society. 2) The sex workers are affected by the fact that the law does not recognize the occupation of sex workers in Thai society. Because Thailand adheres to the concept of good morality and culture, rights, freedoms, or the rights and freedoms to practice an occupation must be contradict to the good morality of Thai society.. Furthermore, the concept of discourse encompasses the creation of negative narratives about sex workers, partly fueled by some media outlets that present them in a negative light to the public. Additionally, regarding sex workers’ rights and benefits, the lack of protective legislation leaves them vulnerable to exploitation by powerful groups involved in the sex industry 3) The approach to having a law to recognize the occupation of sex workers is to create social rights in Thai society that are appropriate and consistent with the current problems. Solving the problem of social rights and citizenship of sex workers must be revised and improved, and all sectors must understand. The amendment must address both the structural and cultural issues of respect for the rights of one's own body and the shared attitudinal structure.

การศึกษาวิจัยนี้ มีวัตถุประสงค์เพื่อ 1) ศึกษาการเสียสิทธิทางสังคมของความเป็นพลเมือง ที่พนักงานบริการทางเพศไม่ได้การรับรองตามกฎหมายในสังคมไทย 2) ศึกษาผลกระทบที่พนักงานบริการทางเพศได้รับเมื่อกฎหมายไม่ให้การรับรองอาชีพของพนักงานบริการทางเพศในสังคมไทย 3) เสนอแนะแนวทางการมีกฎหมายรับรองอาชีพพนักงานบริการทางเพศ เพื่อก่อให้เกิดสิทธิทางสังคมในสังคมไทย ให้เหมาะสมและสอดคล้องกับสภาพปัญหาในปัจจุบันการวิจัยครั้งนี้เป็นการวิจัยเชิงคุณภาพ โดยการศึกษาการวิจัยเชิงเอกสาร ศึกษาและค้นคว้าเก็บข้อมูลจากเอกสารวิชาการ วารสาร งานวิจัยที่เกี่ยวข้อง บทสัมภาษณ์ออนไลน์ แหล่งข้อมูลต่างๆ จากอินเตอร์เน็ตและการสัมภาษณ์โดยการสุ่มตัวอย่างแบบเฉพาะเจาะจงจากนั้นจึงนำข้อมูลมาวิเคราะห์เชิงพรรณนาผลการศึกษาพบว่า 1) การเสียสิทธิทางสังคมของความเป็นพลเมืองที่พนักงานบริการทางเพศไม่ได้การรับรองตามกฎหมายในสังคมไทย ทำให้กลุ่มบุคคลดังกล่าวต้องเสียสิทธิของตนเองจากการเป็นพลเมืองของสังคมไทยหลายประเด็น เช่น ด้านสวัสดิการแรงงาน ด้านความรุนแรง เนื่องจากไม่มีกฎหมายคุ้มครองพนักงานบริการทางเพศ จึงทำให้พนักงานบริการทางเพศกลายเป็นเหยื่อสุดท้ายในวงจรของห่วงโซ่อาหารของสังคมไทย 2) ผลกระทบที่พนักงานบริการทางเพศได้รับเมื่อกฎหมายไม่ให้การรับรองอาชีพของพนักงานบริการทางเพศในสังคมไทย เหตุเพราะประเทศไทยยึดมั่นในแนวความคิดเรื่องศีลธรรมและวัฒนธรรมอันดีงามสิทธิเสรีภาพ หรือ สิทธิเสรีภาพในการประกอบอาชีพนั้นต้องไม่ขัดกับศีลธรรมอันดีงามของสังคมไทย จึงทำให้เกิดปัญหาในเรื่องของศีลธรรมอันดีงามของสังคมไทย ประกอบกับแนวความคิดเรื่องวาทกรรม การสร้างวาทกรรมเชิงลบของพนักงานบริการทางเพศส่วนหนึ่งมาจากสื่อสารมวลชนบางสำนักที่เสนอข่าวสร้างภาพลักษณ์เชิงลบให้กับพนักงานบริการทางเพศออกสู่สาธารณะชนและประเด็นด้านผลประโยชน์พนักงานบริการทางเพศไม่มีข้อกฎหมายที่คุ้มครองทำให้เกิดช่องว่างในการถูกเอารัดเอาเปรียบจากกลุ่มผู้มีอิทธิพลที่เกี่ยวข้องกับพนักงานบริการทางเพศ 3) แนวทางการมีกฎหมายรับรองอาชีพพนักงานบริการทางเพศ เพื่อก่อให้เกิดสิทธิทางสังคมในสังคมไทย ให้เหมาะสมและสอดคล้องกับสภาพปัญหาในปัจจุบัน การแก้ไขปัญหาสิทธิทางสังคมและความเป็นพลเมืองของพนักงานบริการทางเพศต้องมีการแก้ไขปรับปรุงและทำความเข้าใจกับทุกภาคส่วน การแก้ไขต้องแก้ไขทั้งประเด็นเชิงโครงสร้างสังคมและวัฒนธรรมในเรื่องของการเคารพยอมรับสิทธิในเนื้อตัว ร่างกาย และโครงสร้างเชิงทัศนคติร่วมกัน
