| dc.description.abstract | การศึกษาเรื่องนี้มีวัตถุประสงค์ 3 ประการคือ 1. เพื่อศึกษาถึงลักษณะการถูกละเมิดสิทธิมนุษยชนที่แรงงานต่างด้าวสัญชาติพม่า ประสบอยู่ ในเขตอำเภอแม่แตง จังหวัดเชียงใหม่ 2. เพื่อศึกษาอุปสรรคขัดขวางในการที่แรงงานต่างด้าวสัญชาติพม่า จะได้รับผลประโยชน์ตามสิทธิมนุษยชน และ 3. เพื่อเสนอแนะมาตรการที่เหมาะสมสำหรับการป้องกันและแก้ไขปัญหาการละเมิดสิทธิมนุษยชนของแรงงานต่างด้าวสัญชาติพม่า ผลการศึกษาพบว่า การละเมิดสิทธิมนุษยชนของแรงงานต่างด้าว อำเภอเมืองแม่แตง ยังคงมีการละเมิดสิทธิมนุษยชนอยู่ เช่น 1.เรื่องค่าตอบแทน 2.เรื่องสวัสดิการ แรงงานต่างด้าวบางส่วนที่ทำงานในสถานประกอบการขนาดเล็ก 3. เรื่องความรุนแรง การด่าทออันเกิดจากชาตินิยมของคนไทย ในส่วนของกลไกของรัฐไทยและนโยบายที่เกี่ยวข้องกับแรงงานต่างด้าว มีความสอดคล้องกับหลักสิทธิมนุษยชนและหลักสิทธิแรงงา | th_TH |

| dc.description.abstractalternative | This study has three objectives: 1.to study the nature of human rights violationexperienced by Myanmar migrant workers in the district of Mae Taeng; 2. to study the obstruction Burmese migrant workers faced in accessing human rights benefits; and 3. to recommend appropriate measures for preventing and resolving Myanmar migrant workers' human rights violation. This research employs qualitative method. A specific sample group was selected for five groups. The samples used in the study are as follow: sgroup 1- Myanmar migrant workersin the Mae Taeng district area Chiang Mai Province; group 2- Employers in Mae Taeng District Chiang Mai Province; group 3- Staff related to foreign workers; Group 4 -Human Rights Defenders in Chiang Mai Province and group 5 -Kamnan / Village Headman in Mae Taeng District Chiang Mai Province. The study found that Human Rights violation againstforeign workers Mueang Mae Taeng District Human rights continued in such areas as 1. Compensation. 2. Welfare, for example,some migrant workers in small establishments, such as domestic workers, work more than 8 hours a day and do not havetheir overtime pay, neitheras any benefits. Also some workplaces have harzadousworkwithout protective equipment such as construction workers. And 3. violenceandrebuke caused by Thais.Regarding the Thai state mechanism and policies relating to foreign workers,they are consistent with human rights and labor rights principles. But in practice, they are not effective.due to the fact that in some establishments especially small establishments the employersareusually owned by one personwho has sole management decisionmaking power. Therefore it is difficult to tomonitor. This ultimately leads to human rights violations.
