| dc.description.abstract | การศึกษาค้นคว้าอิสระเรื่อง “บทบาทและการมีส่วนร่วมของประชาชนในการจัดทำ แผนพัฒนาองค์การบริหารส่วนจังหวัด” มีวัตถุประสงค์เพื่อศึกษาถึงแนวคิดทฤษฎีและหลักการเกี่ยวกับ การกระจายอำนาจ การมีส่วนร่วมของประชาชน กระบวนการกำหนดแผนพัฒนาท้องถิ่น บทบาท ระดับ การมีส่วนร่วม และกลไกตามกฎหมายที่ประชาชนจะสามารถเข้าไปมีส่วนร่วมในการกำหนดแผนพัฒนา องค์การบริหารส่วนจังหวัด ตลอดจนวิเคราะห์สภาพปัญหาการมีส่วนร่วมของประชาชนตามที่กฎหมาย กำหนดไว้เพื่อเสนอแนะแนวทางการแก้ไขกฎหมายที่เกี่ยวข้องดังกล่าว การศึกษาค้นคว้าอิสระเรื่องนีเป็นการวิจัยเชิงคุณภาพ โดยวิธีการวิจัยทางเอกสาร จากการเก็บ รวบรวมข้อมูลจากบทความทางกฎหมาย ผลงานทางวิชาการ วิทยานิพนธ์ รายงานวิจัยที่เกี่ยวข้อง ตลอดจน กฎหมาย ระเบียบ และข้อบังคับต่าง ๆ จากการศึกษาพบว่าปัญหาการมีส่วนร่วมของประชาชน ได้แก่ ปัญหาการไม่มีบทบัญญัติของกฎหมายที่ชัดเจนในการกำหนดขั้นตอนและวิธีการที่ส่งเสริมให้ประชาชนเข้าไปมี ส่วนร่วมในการกำหนดแผนพัฒนาองค์การบเริหารส่วนจังหวัด และกฎหมายที่มีอยู่ไม่ได้เปิดโอกาสให้ ประชาชนมีส่วนร่วมในการกำหนดแผนพัฒนาองค์การบริหารส่วนจังหวัดร่วมกับองค์การบริหารส่วนจังหวัดอย่างเพียงพอ โดยปัญหาดังกล่าวสามารถแก้ไขปัญหาโดยการตรากฎหมายในระดับพระราชบัญญัติขึ้นใหม่ เพื่อกำหนดหลักเกณฑ์และวิธีการมีส่วนร่วมของประชาชนให้ชัดเจน และในระหว่างที่ยังไม่มีการตรากฎหมายดังกล่าว ควรมีการแก้ไขระเบียบกระทรวงมหาดไทยว่าด้วยการ จัดทำแผนพัฒนาขององค์กรปกครองส่วนท้องถิ่น พ.ศ. 2548 เพื่อกำหนดขั้นตอนและวิธีการมีส่วนร่วม ของประชาชนให้ชัดเจนขึ้น ทั้งนี้ โดยนำรูปแบบการปกครองส่วนท้องถิ่นของประเทศนิวซีแลนด์ที่ได้กำหนดหลักเกณฑ์และวิธีการอย่างชัดเจนในขั้นตอนการกำหนดแผนพัฒนาท้องถิ่น วิธีการตรวจสอบการ ดำเนินการ รวมทั้งวิธีการที่ส่งเสริมให้ประชาชนเข้าไปมีส่วนร่วม นอกจากนี้ ควรมีการสร้างจิตสำนึกที่ดี ให้กับเจ้าหน้าที่และประชาชนในการมีส่วนร่วมในการบริหารกิจการขององค์การบริหารส่วนจังหวัด | th_TH |

| dc.description.abstractalternative | This independent study titled “Public Participation in Provincial Administrative Organization Plans” is conducted with main purposes to study theories, concepts and principles concerning decentralization and public participation, the process of local development planning, roles and public participation spectrum and the legislative mechanism for promoting the public participation in the Provincial Administrative Organization Planning, as well as to analyze the problem situations of the public participation as stipulated in laws in order to revise such relevant laws. The method of the study is a qualitative and documentary research through relevant literature reviews based on the data collected from legal articles, academic works, theses, relevant researches, laws, regulations and rules. The results of this study reveal problems of the public participation including inexplicit legal provision which clarifies the procedure and method of the public participation in the Provincial Administrative Organization Planning, as well as the existing laws which have not yet opened the opportunity widely enough for the public to participate in working with the Provincial Administrative Organization to set up a plan. In order to solve these problems, a new law should be enacted in form of the Act with clear criteria and methods to regulate the public participation. Pending to the new law, the amendment of the Rule of Ministry of Interior on Local Administrative Organization Development Planning, B.E. 2548 is necessary for achieving more explicit procedures and methods of the public participation. In this regard, the local administration of New Zealand which is clear in terms of their criteria and methods for local development planning procedures, guidelines for performance inspection and public participation promotion is included in this study as a good model. Furthermore, the public officials and people should have good conscious mind of the public participation in the management of the Provincial Administrative Organization. | en_US |
