| dc.description.abstract | การศึกษาค้นคว้าอิสระเรื่องความรับผิดของผู้ประกอบกิจการจำหน่ายภาพยนตร์และวีดิทัศน์ ตามพระราชบัญญัติภาพยนตร์และวีดิทัศน์ พ.ศ.255 มีวัตถุประสงค์) เพื่อศึกษาแนวคิดทฤษฎี และหลักกฎหมายเกี่ยวกับ การคุ้มครอง และการกำกับดูแลกิจการภาพยนตร์และวีดิทัศน์ 2) เพื่อศึกษากฎหมายที่เกี่ยวข้องกับการควบคุม ภาพยนตร์และวีดิทัศน์ทั้งของประเทศไทยและต่างประเทศ 3) เพื่อศึกษากฎหมายที่เกี่ยวข้องกับการควบคุม ภาพยนตร์และวีดิทัศน์ ทั้งของประเทศไทยและต่างประเทศ 4) เพื่อหาข้อเสนอแนะมาตรการทางกฎหมายเกี่ยวกับความรับผิดของผู้ประกอบกิจการภาพยนตร์และวีดิทัศน์ ตามพระราชบัญญัติภาพยนตร์และวีดิทัศน์ พ.ศ. 2551 การศึกษาค้นคว้าอิสระนี้ เป็นการวิจัยเชิงคุณภาพด้วยวิธีการวิจัยทางเอกสาร จากการศึกษาค้นคว้าข้อมูลจาก บทบัญญัติแห่งกฎหมายที่เกี่ยวข้อง ตำรากฎหมาย บทความทางวิชาการ งานวิจัยและผลงานทางวิชาการ อื่นๆ ทั้งภาษาไทยและภาษาต่างประเทศ นำมาวิเคราะห์หาข้อสรุปเพื่อทราบถึงแนวความคิด ทฤษฎี หลักเกณฑ์ รวมถึงสภาพปัญหาเกี่ยวกับความหมายของผู้ประกอบกิจการจำหน่ายภาพยนตร์และวีดิทัศน์อำนาจหน้าที่ของนายทะเบียนและพนักงานเจ้าหน้าที่ตามมาตรา 61 และโทษทางอาญาตามมาตรา 38 และมาตรา 54 แห่งพระราชบัญญัติ ภาพยนตร์และวีดิทัศน์ พ.ศ. 2551 เพื่อวิเคราะห์หาหลักเกณฑ์และวิธีการที่เหมาะสมในการดำเนินการดังกล่าว ผลการศึกษาพบว่า ความรับผิดของผู้ประกอบกิจการจำหน่ายภาพยนตร์และวีดิทัศน์ ตามพระราชบัญญัติภาพยนตร์และวีดิทัศน์ พ.ศ. 2551 นั้น มีกระบวนการทางกฎหมายที่เกี่ยวข้องที่สำคัญคือ การกำหนด ความหมายของผู้ประกอบกิจการจำหน่ายภาพยนตร์ และวีดิทัศน์ซึ๋งควรกำหนดขอบเขตเฉพาะผู้ที่ประกอบกิจการทำเป็นธุรกิจเท่านั้น และควรกำหนดขอบเขต อำนาจหน้าที่ของนายทะเบียน และพนักงานเจ้าหน้าที่ในการเข้าไป ตรวจสอบและการค้นควรมีพยานหลักฐานหรือมีเหตุอันควรสงสัยว่ามีการกระทำความผิด และโทษทางอาญา กฎหมายกำหนดไว้เป็นโทษปรับที่มีระวางโทษสูงเมื่อคำนึงถึงลักษณะของความผิด เจตนา และพฤติกรรมในการกระทำความผิดและถือเป็นความผิดเล็กน้อย จึงควรปรับปรุงให้มีความสอดคล้อง และมีสภาพบังคับเพียงพอที่จะสามารถอำนวยความยุติธรรมให้แก่ประชาชนได้อย่างเที่ยงธรรม และมีประสิทธิภาพ | th_TH |

| dc.description.abstractalternative | The purpose of this independent study was 1) to study concepts, theories, and legal principles involved with the protection and regulation of the film and video business; 2) to study Thai and foreign laws involved with the control of films and videos; 3) to study Thai and foreign laws involved with the control of films and videos; and 4) to form recommendations for legal measures involved with the liability of movie and video merchants under the Film and Video Act, B.E. 2551 (C.E. 2008).This was a qualitative research using documentary research methods. The author studied data from laws, law texts, journal articles, and related research reports both from Thailand and other countries. The data were analyzed to reach conclusions about concepts, theories, principles and problems involving the definition of the movie and video sales business, the powers and responsibilities of registration officials and enforcement officials under Clause 61 and the criminal punishments for offenders under Clauses 38 and 54 of the Film and Video Act, B.E. 2551 (C.E. 2008). The author sought to find more appropriate principles and methods for regulating the film and video sales business. The results showed that the first important legal process involved with setting the liability of film and video merchants under the Film and Video Act, B.E. 2551 (C.E.2008) was setting the definition of “a person or enterprise selling films or videos.” The definition should extend to cover only those who undertake the business for a profit. As for the powers and responsibilities of registration officials and enforcement officials, they should only be allowed to inspect or search movie and video sales places when there is evidence of wrongdoing or substantial reason to suspect there has been wrongdoing. As for criminal offenses in this area, the present laws sets a very high fine, but the penalty may be too harsh when considering the nature of the offense, the offender’s intentions and behavior in breaking the law, because it is only a minor offense. The law should be amended to be more compatible with the situation, with just sufficient enforcement to serve justice for the people efficiently while providing fairness. | en_US |
