| dc.description.abstract | การศึกษาครั้งนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาสภาพการบริหารยุทธศาสตร์โดยยึดหลักนิติธรรมของ สํานักงานวัฒนธรรมจังหวัดสมุทรสาคร และ (2) ระบุปัญหา ข้อเสนอแนะและแนวทางการพัฒนาการบริหาร ยุทธศาสตร์โดยยึดหลักนิติธรรมของสํานักงานวัฒนธรรมจังหวัดสมุทรสาคร การศึกษาครั้งนี้เป็นการวิจัยเชิงคุณภาพ โดยวิธีการวิเคราะห์เนื้อหาจากเอกสารที่เกี่ยวข้องทั้งข้อมูล ปฐมภูมิข้อมูลทุติยภูมิ และจากการสัมภาษณ์เชิงลึก โดยเครื่องมือที่ใช้คือ แบบสัมภาษณ์กึ่งโครงสร้าง กลุ่ม ตัวอย่างในการสัมภาษณ์เชิงลึกมีจํานวน 5 คน สุ่มตัวอย่างโดยการเจาะจงตําแหน่ง ประกอบด้วย ผู้บริหารของ สํานักงานวัฒนธรรมจังหวัดสมุทรสาคร 1 คนและบุคลากรของสํานักงานวัฒนธรรมจังหวัดสมุทรสาคร อีก4 คน ผลการศึกษา พบว่า (1) สภาพของการบริหารยุทธศาสตร์โดยยึดหลักนิติธรรม พบว่า มีการนําหลัก นิติธรรมมาใช้ในการกำหนดและบริหารยุทธศาสตร์ของสํานักงานวัฒนธรรม ได้แก่ ก) การบัญญัติกฎหมายและการให้อํานาจในการดําเนินการตามกฎหมายนั้น ข) การทบทวนกฎ ระเบียบ ข้อบังคับ และแนวทางการดําเนินงานที่เกี่ยวข้อง ค) การแต่งตั้งคณะทํางาน ง) ใช้หลักความเสมอภาค และความเที่ยงธรรม โดยให้สิทธิ เสรีภาพแก่ประชาชนในการแสดงอัตลักษณ์ของตนและการเข้าร่วมกิจกรรมอย่างเท่าเทียมกัน จ) จัดเผยแพร่ข้อมูล ผ่านทางช่องต่างๆ ให้แก่ประชาชนและเครือข่ายทางวัฒนธรรม ฉ) การแต่งตั้งคณะกรรมการพิจารณากลั่นกรองการ ดําเนินงานตามพระราชบัญญัติต่างๆ การบังคับใช้กฎหมาย ช) การรับฟังข้อร้องเรียน และรับฟังความคิดเห็นที่ อาจมีผลกระทบต่อกฎ ระเบียบ ข้อบังคับนั้นๆ และนําข้อร้องเรียน ความคิดเห็นต่างๆ ไปดําเนินการภายใต้กรอบ ของกฎหมายต่อไป ทั้งนี้ได้มีการยกตัวอย่างการดําเนินงานตามพระราชบัญญัติภาพยนตร์และวีดิทัศน์ พ.ศ.2551 ซึ่งเป็นกรอบบทบัญญัติที่สําคัญของการดําเนินงานของสํานักงานวัฒนธรรมจังหวัดสมุทรสาครเพื่อให้เห็นเป็น รูปธรรมยิ่งขึ้น และ (2) 1) ปัญหาที่พบ คือ กฎหมายล้าสมัย การนํานโยบายไปปฏิบัติโดยไม่ตอบสนอง ยุทธศาสตร์ การเปลี่ยนแปลงผู้บริหารบ่อยครั้งทําให้การบริหารยุทธศาสตร์ขาดความต่อเนื่องและไม่มี ประสิทธิภาพ 2) ข้อเสนอแนะและแนวทางการพัฒนา คือ สํานักงานวัฒนธรรม จังหวัดสมุทรสาครควร ก) สร้าง ความตระหนักและส่งเสริมการพัฒนาบุคลากรให้เน้นการปฏิบัติงานตามหลักนิติธรรม ข) รวบรวมเสนอปัญหาที่ เกิดขึ้นให้ผู้บริหารพิจารณาปรับปรุงแก้ไขกฎหมาย ค) การออกกฎหมายบังคับใช้กฎหมายอย่างเคร่งครัด ง) การ เฝ้าระวังและสร้างภูมิคุ้มกันทางสังคม จ) การบูรณาการทํางานร่วมกับหน่วยงานที่เกี่ยวข้อง และ ฉ) ให้ ความสําคัญในการดําเนินงานตามพระราชบัญญัติภาพยนตร์และวีดิทัศน์ พ.ศ. 2551 | th_TH |

| dc.description.abstractalternative | The objectives of this study were to: (1) study current circumstance of strategy administration in accordance with the rule of law principle of the Office of Culture of Samutsakhon Province; and (2) identify problems and introduce development approach for strategy administration in accordance with the rule of law principle of the Office of Culture of Samutsakhon Province. This study was a qualitative research conducted by documentary research from primary and secondary sources and in-depth interview. The research tool was a semi-structured questionnaire. Samples were selected by purposive sampling method and position involved, totally 5 persons. They were a director and 4 high position officials of the Office of Culture of Samutsakhon Province. The study revealed that: (1) the current circumstances of strategy administration of the Office of Culture of Samutsakhon Province were the organization applied the rule of law principles in strategy administration as well as the implementation under the oraganization’s strategy such as a) enactment the law and empowerment according to the law b) revision and amendment regulations, law and others concerned issues c) appointment committees d) offering liberty and right to people who were different in races to perform self identity and participate in activities e) instruction useful information to people and cultural networks via various kinds of media f) appointment board to consider the implementation according to the Act of Registration, law enforcement, and g) listening to the complaints or voices of people. This study raised a sample of implementation under the Provision of Film and Video Act B.E.2551 as a guideline to understand the concrete work done by using the rule of law principle; and (2) 1) problems were the obsoleteness of the law, the irresponsiveness to strategy’s goal, often changing CEO. These caused discontinuation and uneffectiveness of strategy administration 2) recommendation and development guidelines were the Office of Culture of Samutsakorn Province should a) promote the recognition and develop human resources to work according to the rule of law principle b) collect and present the problems to CEO for amending relevant laws c) enact laws and enforce strictly d) guard and create social immunity e) integrate the work with other agencies f) give importance to the activities under the Provision of Film and Video Act B.E. 2551 | en_US |
