The legal measures regarding the supervision of dogs by local administrative organization

Abstract

This independent study aims to (1) explore the concepts related to dog control and management by local government organizations, (2) examine legal measures for dog control by local government organizations in Thailand and other countries, (3) analyze legal issues for dog control by local government organizations, and (4) propose recommendations for amending the laws regarding dog control by local government organizations.This independent research is a qualitative study involving a review of documents such as textbooks, articles, theses, dissertations, relevant electronic media, legal documents, and various legal provisions. The goal is to obtain systematic and appropriate knowledge that can lead to effective improvements in laws governing dog control by local government organizations.The study findings are as follows: (1) For the concepts of animal rights and welfare, all animals have the rights to proper care. More over, they must not be abandoned or allowed to die. (2) Local Government Dog Control Laws: Currently, only Bangkok's regulations are in force for dog control, unlike Japan and New Zealand, which have specific, strictly enforced dog control laws. (3)There are problems related to Current Local Government Dog Control Laws. The law lacks of specific legal provisions for dog control, absence of measures for dog registration and appropriate penalties, challenges in regulating dog sales, and the increase in stray dogs due to insufficient government control measures. (4) recommendations for Legal Improvement: is to amend the Public Health Act B.E. 2535 (1992), Section 29, Paragraph 3, to grant local government organizations the authority to manage dog control within their jurisdictions, supported by ministerial regulations to ensure uniform application across the entire kingdom.

การศึกษาค้นคว้าอิสระนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาแนวคิดเกี่ยวกับการควบคุมดูแลสุนัขขององค์กรปกครองส่วนท้องถิ่น (2) ศึกษามาตรการทางกฎหมายในการควบคุมดูแลสุนัขขององค์กรปกครองส่วนท้องถิ่นในประเทศไทย ประเทศญี่ปุ่น และประเทศนิวซีแลนด์ (3) วิเคราะห์ปัญหาทางกฎหมายในการควบคุมดูแลสุนัขขององค์กรปกครองส่วนท้องถิ่น (4) เสนอแนะแนวทางการแก้ไขกฎหมายการควบคุมดูแลสุนัขขององค์กรปกครองส่วนท้องถิ่น
